Overview: EB-5 Investment Visa Program Benefits
The EB-5 visa program has been providing foreign investors benefits since 1990. While the US benefits from new jobs created in the program as well as a boost to the economy as these new businesses develop and thrive, investors receive several personal benefits as a result of their investment in the US economy.
Residency. The EB-5 investor, his or her spouse, and their children under the age of 21 can enter the US through visas granted by EB-5 program participation. Green cards allow holders to work and live anywhere in the US, with much of the same rights and benefits as US citizens. While green card holders cannot vote in US elections, the EB-5 program includes a pathway to citizenship for those who apply. Former green card holders who become US citizens can vote.
One-time investment. The program requires a minimum initial investment in a job-creating enterprise. The initial investment is currently $1 million, or $500,000 if investing through an approved Regional Center like American Life, Incorporated, in a designated low employment area. However, these minimums are set to increase as of November 21, 2019 to $1.8 million, or $900,000 for investments in the designated low employment areas, so now is a perfect time to invest through the program.
Low to no day-to-day business management. Investors using a Regional Center do not have to be involved in day-to-day management of the business. Instead, they serve as limited partners, with the Regional Center as the general partner that manages the business enterprise. This leaves investors free to live anywhere in the US, whether or not they are located near their investment enterprise.
Educational advantages. As green card holders and legal residents, investors, their spouses, and their children qualify for in-state tuition at higher education institutions in their state of residence as well as scholarships. In-state tuition is considerably less expensive than foreign or out-of-state tuition, making a good university education more affordable for investor families.
Travel. EB-5 visa holders are free to travel throughout the US as well as internationally, with no denials upon reentry to the US. However, long-term absence from the US may require advanced planning to ensure that the government does not consider the green card abandoned. Those traveling abroad for several months may need to apply for a re-entry permit.
Language. There is no English language requirement for EB-5 visa program investors, so you don’t need to know how to read or speak English. However, the forms required for the program are written in English, so you will need an interpreter and will need to sign these forms. American Life, Incorporated provides interpreters for over 150 languages at no cost to their clients.
