The EB-5 Investment Process: Requirements

It’s a new year, and our EB-5 investors are continuing to realize healthy profits. If you’ve been thinking about investing in US real estate, 2019 is a great year to take advantage of the many benefits of the EB-5 investment program. Our specialists answer questions every day about the program, and today we’ll focus on some of the program’s requirements.

For those investing in a new commercial enterprise, the requirements are as follows:

  • The investment amount must be at least $1 million unless the investment is located in an area designated as a Targeted Employment Area (TEA). In a TEA, the minimum investment is $500,000. A TEA is an area with higher unemployment than the national average.
  • The enterprise must provide goods or services that benefit the US economy.
  • The investment must create 10 full-time positions for US workers.
  • The investor must be involved in the daily management of the enterprise.

For those investing in a troubled business, the requirements are as follows:

  • The targeted business must have existed for at least two years.
  • The business must have experienced a net loss for one to two years before filing for the investor applies to the EB-5 program.
  • The number of jobs in the business must be maintained, at a minimum, at the level the business had before the investment.
  • The investor must be involved in the daily management of the business.
  • The investment required is $1 million unless the business is in a designated TEA.

When investing through a designated Regional Center, such as American Life, Incorporated, the requirements are as follows:

  • The investment required is $1 million unless the business is in a designated TEA.
  • Each investor must create at least 10 new full-time US jobs, directly or indirectly.
