Your EB-5 Visa: The Process

When handled through a Regional Center, it’s basically a three-step process: register, invest, and file the necessary petitions.
The first step is registering with your Regional Center and qualifying as an accredited investor. Qualifying involves determining your net worth and income and ensuring that they fall within the limits of the applicable laws. Once qualified, you then review the investment opportunities and choose one that suits your investment needs.
The second step is funding the investment that you’ve chosen. Paperwork at this stage includes a subscription agreement with the Regional Center and the I-526 petition with the US government for temporary residence in the US. The US Customs and Immigration Service (USCIS) is the agency that reviews and approves these petitions. It takes about 16 to 20 months for approval, but this varies by individual situation and can be shorter. Once approved by USCIS, you’ll have an interview at a US consulate or embassy before approval of your conditional, two-year green card. At that point, you and your family can arrive in the US.
The final step is filing the I-829 petition for a permanent green card, which is done about 21 months after you entered the US. Once approved, the EB-5 visa process is complete, and you can enjoy permanent residency in the US while benefiting from your investment, which also benefits the US through job creation.
The EB-5 process has no requirements for business experience or education and does not require that you speak English, although all agreements and government forms are written in English.
